We encourage our customers, visitors, business associates, and other interested parties to read this Privacy Policy, which applies to all users, including users who are simply viewing content available via the Website as well as users who have subscribed to the Services. By using the Website or submitting personal information to SWEAP by any other means, you acknowledge that you understand and agree to be bound by this Privacy Policy, and agree that SWEAP may collect, process, transfer, use and disclose your personal information as described in this Policy. Further, by accessing any part of the Service, you are agreeing to THE TERMS AND CONDITIONS CONTAINED IN OUR TERMS OF USE (the “TERMS OF USE”). Collection, Use, Disclosure, and Retention of Data

SWEAP may collect, use, disclose and retain your personal and non-personal information as described herein. In addition, your data may be transferred to the United States as described in Section 2.

SWEAP does not collect or process financial information. All electronic payment information is processed through Intuit, a third-party.

Collection of your personal information

You can visit the public sections of this Website without identifying yourself or providing personal information. But to gain access to the Services offered through this Website, you must first register with us. When you use this Website, you may affirmatively provide us certain personal information, including but not limited to, the following:

  • Name, address, email address, telephone number(s), and any other identifier by which you may be contacted online or offline;
  • Content that you create in your account including, but not limited to, files you upload and the data in any forms that you fill out;

When you visit this Website, we may track information about your visit and store that information in web server logs, which are recorded activities on this Website. The servers automatically capture and save the information electronically. Examples of the information we may collect include:

Social work programs may opt out of allowing SWEAP to collect data. However, the program will be unable to use SWEAP services.

Ownership of your information

Social work programs own their data. The program has access to their data through the User Interface. The program can request that their data be expunged from SWEAP by submitting a written notice. SWEAP retains the right to use the program data for aggregate analyses, publication, and/or conference presentations towards the goal of improving social work education

How we use your information

We require the above personal information to understand your needs and provide you with a better service, and in particular for the following reasons:

  • Internal record keeping;
  • To present our Website and its contents to you;
  • To allow you to participate in interactive features on our Website;
  • To improve our Services and user experience;
  • To customize this Website according to your interests and needs;
  • To send you email communications regarding product updates, events, and other useful information, though you may, at any time, unsubscribe from these communications;

  • To fulfill any other purpose for which you provide it;

In addition to the above purposes, SWEAP reserves the right to use anonymized information to perform research using the information it obtains from users.

How we disclose your information

SWEAP does not share any social work program or student data with any third party. Social work program information, including program name and contact information of a program representative, may be shared by SWEAP with third parties for the purposes of business functions, primarily including invoicing and marketing communications. We use Intuit to process credit card transactions and manage our invoicing process. If programs use the SWEAP invoicing process or pay for instruments and services through credit card processing, the program acknowledges and agrees that they are also bound by Intuit’s privacy policy. SWEAP retains the right to use a client relations manager to manage our marketing outreach with current and prospective program users. Programs can opt out of inclusion in the client relationship management system. Programs that do not opt out of inclusion in the client relationship management system are agreeing that they are also bound by that system’s privacy policy

We may disclose the information we collect in the following circumstances:

  • If you are a student completing a SWEAP assessment, we may disclose your personal information to the university at which you are enrolled and the site at which you do your internship/practicum.
  • As permitted by law. For example, we may share information with regulatory authorities and law enforcement officials who have jurisdiction over us or if we are required to do so by United States or other applicable law; provide information to protect against fraud; share information with your consent; and give account information to other service providers who work for us or you.

Data storage and retention

Your personal information is stored by SWEAP on the servers of the cloud-based database management services SWEAP engages, located in the United States. SWEAP protects your data consistent with the Security and Performance standards described in the Terms of Use.

SWEAP retains data for the duration of the customer’s or member’s business relationship and/or in accordance with applicable data retention and destruction regulation(s). International Data Transfer

For individuals in Switzerland, the European Union (EU), and other countries outside the United States, please note that SWEAP is a United States based company. If you use the Service, all information, including personal information, will be transferred to SWEAP (including third parties to which data was disclosed as described above) in the United States. Although this may include recipients of information located in countries where there may be a lower level of legal protection for your personal information than in your country, we will protect your information in accordance with requirements applicable to the law in your particular jurisdiction. In addition, SWEAP will take reasonable steps to permit individuals to correct, amend, or delete information it holds about them. SWEAP also relies upon each individual to assist in providing accurate updates of his or her personal information. If you send us a private or direct message via social media, the message will be stored as per that social media platforms privacy policy, and the SWEAP Privacy Policy will not apply.

People Who Email Us

We use Google Mail for e-mail system as a third-party service provider. We selected Google because it complies with certain information security requirements, including but not limited to ISO 27001 and EU GDPR. Emails sent by SWEAP will default be encrypted in transport by G-Suite.

We do not guaranty that receivers of our emails have encryption enabled or available, therefore it is your responsibility to ensure encryption at your end.

We will also monitor any emails sent to us, including file attachments for viruses or malicious software. Please be aware that you have a responsibility to ensure that any email you send is within the bounds of the law.

Children

This Website is not intended for use by children under the age of 16. We understand the importance of protecting children’s information, especially in an online environment, and we do not knowingly collect or maintain information about children.

Choice of Law

You agree that any dispute over privacy or the terms contained in this Privacy Policy, or any other agreement we have with you, will be governed by and construed in accordance with the laws of the State of Colorado, as permitted by the law in your particular jurisdiction. Any dispute between the parties arising under or relating to this Privacy Policy shall be subject to the exclusive jurisdiction of the United States District Court for the State of Colorado or the State courts sitting in Weld County, as permitted by the law in your particular jurisdiction. Financial Incentives

Where SWEAP offers these programs, your participation is optional. If you choose to participate, your participation will be subject to any applicable terms, and you may withdraw at any time.
